Spectra Logic Media Return Policy

Spectra Logic warrants you that Spectra Certified Media products are free from defects in materials and workmanship, commencing from the time of purchase and for the Lifetime of the product.  If during this time Spectra is notified of a defect, Spectra will replace the media in conjunction with the return of the defective media. Spectra’s Lifetime Guarantee applies to the normal working life of the media product defined as being no greater than four (4) generations of tape technology (e.g., LTO-9, LTO-8, LTO-7 and LTO-6), and based upon the actual media manufacturer’s definition, which may be dependent on, for example, the number of passes, full backups, restores, or possible combination thereof. Spectra Logic reserves the right to troubleshoot any issue to determine if replacing the media is the correct action. Spectra Logic will replace the media once suitable steps have been taken.

This guarantee does not apply to defects caused by misuse, improper storage, normal wear and tear, or the media reaching the end of its normal working life. Improper storage includes not complying with the media manufacturer’s recommended optimum storage temperatures and humidity. If you require additional details, please contact Spectra Logic Support.

TO THE EXTENT ALLOWED BY LOCAL LAW, THE ABOVE WARRANTY IS EXCLUSIVE AND NO OTHER WARRANTY OR CONDITION, WHETHER WRITTEN OR ORAL, IS EXPRESSED OR IMPLIED AND SPECTRA LOGIC SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE.

This warranty gives you specific legal rights and you may also have other rights that vary from state to state, or province to province. THE REMEDIES PROVIDED IN THIS WARRANTY STATEMENT ARE CUSTOMER’S SOLE AND EXCLUSIVE REMEDIES. IN NO EVENT WILL SPECTRA LOGIC OR ITS SUPPLIERS BE LIABLE FOR LOSS OF DATA, DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS) WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
